On 3 May the Competition and Markets Authority (CMA) issued its final determination on the allocation of costs in relation to the EDF Energy/SSE appeal on Connection and Use of System Code (CUSC) proposal CMP261. For many this will have been below the radar, but we think the high costs hold some significant implications. In this Energy Perspective, we consider the current options for appealing code decisions and argue that they are skewed in favour of the large incumbent players who are the only ones with deep enough pockets to contemplate such moves.
